Thank you for using our products and services (the "Services"). The Services are provided by ArcoVPN.
By using our Services, you agree to these Terms. Please read them carefully.
Our Services are broad, so additional terms or product requirements, including age requirements, may sometimes apply. Additional terms will be provided with the relevant Services and become part of your agreement with us when you use those Services.
1. Using the Service
You must follow all policies made available within the Services.
Do not misuse our Services. For example, you may use our Services only as permitted by law. We may suspend or stop providing Services to you if you do not comply with our terms or policies, or while we investigate suspected misconduct.
We do not set fixed system resource or hardware limits for each account. We will not proactively disable user accounts unless they greatly exceed acceptable usage levels. Activities that may cause this include sustained resource consumption, long-running high-volume downloads, and similar behavior.
Your monthly traffic allowance is determined by the specific service you purchase. If your traffic usage exceeds your monthly limit, your account will be suspended until it is restored after the billing date for the current cycle. Unused traffic does not roll over to the next usage cycle.
Using our Services does not give you ownership of any intellectual property rights in our Services or in the content you access. You may not use any content from the Services unless you obtain permission from its owner or are otherwise permitted by law. These Terms do not grant you the right to use any trademarks or logos used in our Services. Do not remove, obscure, or alter any legal notices displayed on or along with our Services.
Our Services may display content that does not belong to ArcoVPN. The entity that makes that content available is solely responsible for it. We may review content to determine whether it is illegal or violates our policies; if we reasonably believe it violates our policies or the law, we may remove it or refuse to display it. This does not mean that we necessarily review content, so please do not assume that we do.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.
Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you or violates traffic or safety laws.
You agree that you are responsible for preventing minors under your care from directly or indirectly accessing any harmful or inappropriate content through ArcoVPN Services you purchase. You agree not to allow minors to access any ArcoVPN Service and to take appropriate restrictions to prevent them from doing so. If you are a parent or guardian of a minor, you agree that you are responsible for preventing that minor from accessing any inappropriate content through ArcoVPN Services.
Some of our Services may depend on third-party client applications. Sufficient tutorials for those applications can be found on the internet through search engines. We only provide our specific types of services and reserve the right to refuse guidance or instruction for third-party client software. Please learn the relevant information before purchasing.
We expect users to use each Service as described. If, in our judgment, a user uses a Service unreasonably, we may take action to reduce the negative impact. Unfair use includes, but is not limited to:
- Lending, leaking, or reselling ArcoVPN accounts or Services.
- Continuous use of any P2P, BT, or PT download services.
- Exceeding the number of users allowed by the service plan.

2. ArcoVPN Account
To use some of our Services, you may need an ArcoVPN account. You may create your own ArcoVPN account, or an administrator, such as your employer or educational institution, may assign one to you. If you use an ArcoVPN account assigned by an administrator, additional or separate terms may apply, and your administrator may be able to access or disable your account.
To protect your ArcoVPN account, keep your password secure and confidential. You are responsible for activity that happens on or through your ArcoVPN account. Try not to use your ArcoVPN account password in third-party applications. If you discover unauthorized use of your password or ArcoVPN account, reset your password immediately.
3. Privacy and Copyright Protection
ArcoVPN's Privacy Policy explains how we handle your personal data and protect your privacy when you use our Services. By using our Services, you agree that ArcoVPN may use your personal data in accordance with our Privacy Policy.
ArcoVPN does not proactively inspect the content users access through ArcoVPN Services, although ArcoVPN may, at its sole discretion, use technical means to monitor the services customers use on the ArcoVPN network and disclose any necessary account information when required by law, regulation, or government authority. ArcoVPN will investigate complaints involving infringement of third-party rights or violations of the Acceptable Use Policy. ArcoVPN will seek to reduce abuse of ArcoVPN Services. ArcoVPN has the right to cooperate with law enforcement agencies and reserves the right to notify those agencies if they suspect that you or your end users are engaging in activities that violate the laws, regulations, or related policies of your location or the server location. All terms in this section are intended to grant third-party rights, but no third party has the right to enforce any provision of this agreement.
We respond to notices of alleged copyright infringement under the process set out in the U.S. Digital Millennium Copyright Act and terminate accounts of repeat infringers.
We provide information to copyright holders to help them manage their intellectual property online.
4. Your Content in Our Services
Some of our Services allow you to upload, submit, store, send, or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you remains yours.
When you upload, submit, store, or send content to our Services, and when you upload, submit, store, send, or receive content through our Services, you grant ArcoVPN and our partners a worldwide license to use, host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform, publicly display, and distribute that content. Derivative works may include translations, adaptations, or other changes we make so your content works better with our Services. The rights you grant in this license are used only to operate, promote, and improve our Services and to develop new services. This license continues even after you stop using our Services. Some Services may provide ways for you to access and delete content you have provided to that Service. In addition, terms or settings in some of our Services may narrow our use of content submitted to those Services. Please make sure you have the necessary rights to grant us this license for any content you submit to our Services.
You can find details about how ArcoVPN uses and stores content in the privacy policy or additional terms for the relevant Service. If you submit feedback or suggestions about our Services, we may use them without any obligation to you.
5. Software in Our Services
If a Service requires downloadable software or includes downloadable software, that software may automatically update on your device when a new version or feature is available. Some Services may allow you to adjust automatic update settings yourself.
We may provide third-party products, services, and/or software that are not part of the Services ("Third-Party Services or Software") to you. We cannot control the content of Third-Party Services or Software. Any use of Third-Party Services or Software is at your own risk and is subject to the terms and conditions of your separate agreement with the relevant third party.
Some software may not be owned by us. You may not modify, publish, sell, or lease any part of that software, nor may you reverse engineer or attempt to extract its source code, unless laws prohibit those restrictions or you have written permission for the software.
Open-source software is important to us. Some software used in our Services may be offered under an open-source license, and we will make that license available to you. Provisions in an open-source license may expressly override some of the terms above.
6. Acceptable Use Policy
You agree to comply with ArcoVPN's Acceptable Use Policy, portions of which are incorporated into this document by reference and form an integral part of it. ArcoVPN posts revised policies on the website and reserves the right to modify the Acceptable Use Policy at any time. ArcoVPN is also obligated to notify users of Acceptable Use Policy updates, including but not limited to email notices, website notices, and social media notices. You agree to visit the ArcoVPN website regularly and review the latest Acceptable Use Policy. Continuing to use Services provided by ArcoVPN after any Acceptable Use Policy change log means that you accept and are bound by the new Acceptable Use Policy. If an end user violates the Terms of Service or the Acceptable Use Policy, ArcoVPN has the right to suspend your access to the Services at any time. You must agree that ArcoVPN will not be responsible for any conduct by you that violates the Acceptable Use Policy or the laws, regulations, and related policies of the server location, including the Digital Millennium Copyright Act.
7. Modifying and Terminating Services
We are constantly changing and improving our Services. We may add or remove features, and we may suspend or stop a Service entirely.
You may stop using our Services at any time, although we would be sorry to see you go. ArcoVPN may also stop providing Services to you at any time, or add or create new limits on our Services at any time.
We believe it is important that you own your data and retain access to it. If we discontinue a Service, where reasonably possible, we will give users reasonable advance notice and an opportunity to export information from the Service.
ArcoVPN may, at its sole discretion, terminate your access to ArcoVPN Services and terminate this agreement if you, your end users, or downstream customers violate the Terms of Service or Acceptable Use Policy.
ArcoVPN may also terminate this agreement at any time for any reason or no reason ("termination without cause"). In that case, ArcoVPN will provide you with written notice.
8. Warranties and Disclaimers
We provide the Services using a commercially reasonable level of skill and care, and we hope you enjoy using them. But there are certain things about the Services that we cannot promise.
Except as expressly provided in these Terms or additional terms, ArcoVPN and its suppliers and distributors make no specific promises about the Services. For example, we make no commitments about the content within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. The Services are provided "as is."
Some jurisdictions provide certain warranties, such as implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we exclude all warranties.
ArcoVPN may provide a Service Level Agreement (SLA) for some Services to guarantee a certain level of availability. If you need additional SLA protection, please contact us; it will be introduced as an additional and integral part of this agreement.
To receive SLA outage compensation, you must notify us according to a specific process. You understand and agree that if you fail to follow the required process within three days after an SLA outage event is triggered, you will automatically waive your right to receive SLA compensation. 9. Liability for the Services
To the extent permitted by law, ArcoVPN and its suppliers and distributors are not liable for lost profits, lost revenue, lost data, financial losses, or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of ArcoVPN and its suppliers and distributors for any claim under these Terms, including any implied warranties, is limited to the amount you paid us to use the Services, or, at our option, providing the Services to you again.
In all cases, ArcoVPN and its suppliers and distributors are not liable for any loss or damage that is not reasonably foreseeable.
We understand that in some countries or regions, you may have certain legal rights as a consumer. If you use the Services for personal purposes, these Terms or additional terms do not limit any consumer legal rights that cannot be waived by contract.
10. Business Use of the Services
If you use our Services on behalf of a business, that business must accept these Terms. The business will indemnify and hold harmless ArcoVPN and its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to use of the Services or violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys' fees.
11. Payments and Promotions
Your payments for the Services must be paid in advance within the payment period. Unless you follow the ArcoVPN Service cancellation procedure specified in this agreement, the Services will be billed automatically and periodically.
Unless you and we specifically negotiate and agree in writing, the setup fees and recurring payment fees for the Services you select must be paid together as initial fees when ordering online. All setup/installation fees and special setup fees are non-refundable. Service fees must be paid in advance; if service fees are not paid on time, your Service may be suspended or deleted.
When paying, you must choose a payment method. ArcoVPN reserves the right to enter into agreements with third parties to process all payment requests. Such third parties may impose additional terms and conditions governing payment processing. If you fail to pay service fees when due, ArcoVPN reserves the right, to the extent permitted by law, to charge certain late fees.
You agree to pay any taxes resulting from use of the Services, including personal income tax, value-added tax, or sales tax. ArcoVPN is not responsible for any fees arising from your use of the Services and your use of bank checks, credit cards, insufficient funds, or any fees charged by your financial institution. ArcoVPN must receive full payment; if additional costs arise from taxes, exchange-rate differences, bank fees, transfer fees, or similar charges, you must pay them yourself.
ArcoVPN may offer coupons and promotional codes from time to time. Unless otherwise stated, these coupons and promotional codes apply only to first-time purchasers. If you have already ordered ArcoVPN Services, these promotions may not take effect. These coupons and promotional codes may not apply to product upgrades. If you attempt to abuse coupons or promotional codes, your account or Service may be suspended or even deleted.
Unless stated in writing, all paid Services provided by ArcoVPN are considered non-refundable.
Some products and Services may allow refunds, but ArcoVPN has the right to deduct necessary payment gateway fees or other costs when issuing a refund. The refund you ultimately receive may differ from the amount you expected. ArcoVPN will not provide assistance for such issues.
For refundable products or Services, please submit a support ticket requesting a refund within 24 hours from the date of purchase. Refunds cannot be issued after that period. If you have consumed a significant amount of the resources allocated to that product or Service, ArcoVPN has the right to refuse your refund.
If you cancel a paid Service provided by us without contacting us, it will be treated as your unilateral cancellation of the agreement with us and does not mean that you are automatically entitled to a refund.
Some of our Services require third-party client software to use, and you may need to pay to use certain client software. Unless stated in writing, ArcoVPN has no obligation to pay any fees for such third-party client software on your behalf. For certain third-party client software provided free or at a discount with specific ArcoVPN Services, if the price of that client software changes in the future, ArcoVPN has no obligation to pay subsequent fees for it. You may choose whether to pay for it yourself to continue using those third-party clients.
12. Price Changes
The price of the Service you paid for will not change for a certain period of time. We reserve the right to change ArcoVPN Service prices at any time without notice, and to modify the amount of resources provided to users. In addition, if we terminate your Service under "termination without cause" and later decide to provide Services to you again, your previous fees will not be applied to the new Service. You must still review the fee details for the new Service and complete payment. ArcoVPN will not automatically update your subscription; all upgrades or downgrades will be made according to your request. Changes to certain Services may require you to pay additional setup fees.
ArcoVPN may adjust the price of subscriptions or Services. Unless ArcoVPN states otherwise in writing, such adjustments may apply only to new purchases. Whether prices increase or decrease, the renewal price for subscriptions or Services you have already purchased will not change.
13. Electronic Communications
You agree to receive our communications electronically, such as by email or in-app messages, and agree that such notices satisfy any legal requirement that communications be in writing. You agree that we may communicate with you to inform you about changes or additions to the Services, any of our products or Services, or for other purposes that are reasonable or required by applicable law.
When communicating with our customer support representatives, you agree to remain respectful and friendly. If we believe at any time that your conduct toward any of our customer support representatives or other employees is threatening or abusive, we reserve the right to terminate your account immediately.
14. About These Terms
We may modify these Terms or any additional terms that apply to a Service, for example, to reflect changes in the law or changes to our Services. You should review these Terms regularly. We will post notice of modifications to these Terms on this webpage. We will post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will take effect immediately. If you do not agree to the modified terms for a Service, you should stop using that Service.
If these Terms conflict with additional terms, the additional terms will control.
These Terms govern the relationship between ArcoVPN and you, and do not create any third-party beneficiary rights.
If you do not comply with these Terms and we do not take action immediately, that does not mean we waive any rights we may have, such as taking action in the future.
If a particular term is not enforceable, this will not affect the validity of the other terms.
Courts in some countries or regions will not apply California law to certain types of legal disputes. If you live in one of those countries or regions, and California law does not apply, the laws of your country or region will apply to such disputes related to these Terms. Otherwise, you agree that the laws of the State of California, U.S.A., excluding California choice-of-law rules, will apply to any disputes arising out of or relating to these Terms or the Services.
