ArcoVPN Service-Specific Terms

The following terms apply only to ArcoVPN cloud services.

1. Account Setup

  1. When registering an account, the customer will be asked to provide a sign-in account (email address) and password. The customer may use the service or modify their data and content only through this user ID and password. The customer is fully responsible for keeping the username and password confidential and for all activity that uses these credentials. The customer agrees to notify ArcoVPN immediately of any unauthorized use of the account or any other security breach.
  2. The customer must provide a primary email address and keep it available. All notices and communications from ArcoVPN will be sent to that address, so the customer must keep it reachable and notify ArcoVPN if it changes. If the customer’s contact and/or billing information changes, notify ArcoVPN so the account can be updated. Make sure that ArcoVPN’s domains and any sending addresses ArcoVPN tells you about are not on any spam block list used by you or your email provider.
  3. Incorrect or inaccurate contact information may prevent ArcoVPN from providing the service properly, and service interruptions caused by it are not covered by the SLA. Providing false or fraudulent information of any kind may result in termination of the customer’s account.
  4. The customer is responsible for all activity on and changes to the account. ArcoVPN therefore strongly recommends strict confidentiality measures for files, subscriptions, passwords, and similar information. ArcoVPN assumes the customer has the technical ability to manage the service. The customer is responsible for any problems caused by changes to the account, including but not limited to loss of or damage to any website, software, or device.

2. Payment

  1. Payment covers the entire ArcoVPN service period and is subject to this agreement. Unless the service has been terminated, ArcoVPN will remove the customer’s service after the paid period expires. This is an automatic and irreversible process.
  2. Unless otherwise negotiated and agreed in writing between the customer and ArcoVPN, setup fees and recurring fees for the selected service must be paid together as initial charges when ordering online. Setup/installation fees and special setup fees are non-refundable. Service fees are payable in advance; if they are not paid on time, the customer’s service may be suspended or removed.
  3. When registering, the customer must choose a payment method. ArcoVPN reserves the right to contract with third parties to process all payment requests, and such third parties may impose additional terms and conditions governing payment processing. If the customer fails to pay fees when due, ArcoVPN reserves the right to charge a late fee to the extent permitted by law.
  4. The customer agrees to pay any taxes arising from use of the service, including income tax, VAT, or sales tax. ArcoVPN is not responsible for any charges arising from the customer’s use of bank checks or credit cards, insufficient funds, or the customer’s dealings with their financial institution. ArcoVPN must receive payment in full; any additional costs from taxes, exchange-rate differences, bank charges, or transfer fees are the customer’s responsibility.
  5. The customer also agrees to pay any attorney fees, collection fees, and other costs incurred by ArcoVPN. ArcoVPN does not refund setup fees, special setup fees, or remaining prepaid fees in cash; the unused portion of a subscription may be credited to the account balance on a pro-rata basis as described in the Terms of Service.
  6. Coupons and promo codes – ArcoVPN may offer coupons and promo codes from time to time. Unless stated otherwise, they apply only to first-time purchases and may not take effect if the customer has already ordered ArcoVPN services. They may not apply to upgrades of currently available products. Any customer who attempts to abuse coupons or promo codes may have their account suspended or deleted.
  7. If you use a referral link from another account you own when purchasing, we may disable both the referring account and the purchasing account.

3. Resource Usage

  1. ArcoVPN does not set fixed system resource or hardware limits for each account. ArcoVPN will not proactively disable a customer’s account unless its usage greatly exceeds acceptable levels or continuing that usage would seriously affect other customers.
  2. ArcoVPN does not set monthly data transfer quotas for subscriptions. Customers must use the service within fair-use limits; where sustained high-volume downloads or abnormal resource usage seriously affect other customers, ArcoVPN may rate-limit or suspend the service concerned.
  3. ArcoVPN provides specific services to its customers and requires customers to use them normally, fairly, and reasonably in every billing period. ArcoVPN expects users to use each service as described. If ArcoVPN determines that a customer is using a service unreasonably, ArcoVPN may take action to mitigate the negative impact. Unfair use includes, but is not limited to:
    • a. Lending, leaking, or reselling ArcoVPN accounts or services.
    • b. Continuous use of any P2P, BT, or PT download service.
    • c. Exceeding the number of users allowed by the plan.
    • d. Running resource-intensive programs on a single resource point for long periods.
    • e. Activities on a resource point that violate the laws and regulations of the country or region where it is located.

4. Indemnification

  1. The customer agrees to defend, indemnify, and hold harmless ArcoVPN and its affiliates from any and all claims and liabilities, including reasonable attorney and expert fees, arising from:
    • a. The customer’s breach of this agreement;
    • b. The customer’s use of ArcoVPN services;
    • c. Any activity carried out using your username and password;
    • d. The sale of any goods or services, or advertising of content, information, or data related to the customer;
    • e. Any defamatory, slanderous, or unlawful material in the customer’s content, information, or data;
    • f. Any claim that the customer’s content, information, or data infringes any third party’s patent, copyright, or other intellectual property rights, or violates any third party’s privacy or publicity rights;
    • g. Any third party’s access to or use of the customer’s content, information, or data;
    • h. Any violation of an applicable Acceptable Use Policy.
  2. You warrant and represent that:
    • Your content and titles comply with the laws of China;
    • All people depicted in your content are over 18;
    • Your content does not contain child sexual abuse material, obscenity, bestiality, real depictions of violence, or any images that are unlawful in China.
  3. ArcoVPN may provide you with third-party products, services, and/or software that are not part of the service ("Third-Party Services or Software"). ArcoVPN does not control the content of Third-Party Services or Software. The customer uses any Third-Party Services or Software at their own risk and subject to the terms of any separate agreement between the customer and the third party.
