Acceptable Use Policy (AUP)

1. General
The following is the ArcoVPN Acceptable Use Policy (AUP) (the "Use Policy"). Before using ArcoVPN services, you must agree to this Use Policy, and you also agree to require your end users to comply with it. ArcoVPN reserves the right to modify this Use Policy at any time without any obligation to notify you. ArcoVPN agrees to post this Use Policy at a fixed location on https://www.ArcoVPN.com. You agree to visit this page regularly to review the latest Use Policy, and your continued use of ArcoVPN services means that you continue to agree to this Use Policy.

- You - references to "you" and other second-person pronouns such as "your" in this Policy mean you as an ArcoVPN user.
Under the agreement, https://www.ArcoVPN.com may, at its sole discretion, terminate your access to the services if your conduct violates or is suspected of violating this Use Policy.
2. Prohibition of Illegal and Prohibited Uses
As a condition of using ArcoVPN services, you may not use the services provided by ArcoVPN for any unlawful purpose, or you will be prohibited from using the services. You may not use the services in any way that could damage the services provided by ArcoVPN.
3. Use of the Service
The services are designed to let you communicate with others over the internet. You agree to use the services only to post, send, and receive appropriate messages. Where applicable, you agree to use the services properly. For example, and without limitation, you agree that when using the services, you will not:
- Use the services in connection with illegal contests, gambling, illegal lotteries, spam, or any repetitive and unsolicited messages.
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, such as privacy and publicity rights.
- Publish, post, upload, distribute, transmit, or disseminate any defamatory, obscene, or otherwise unlawful content, such as child sexual abuse material or virtual child sexual abuse material.
- Publish, post, upload, distribute, or disseminate any topic, name, material, or information that incites discrimination, hatred, or violence against a person or group based on race, religion, ethnicity, or nationality.
- Upload or otherwise provide images, photos, software, or other materials protected by intellectual property laws, including but not limited to copyright or trademark laws and rights such as privacy or publicity rights, unless you own or control the rights or have obtained the necessary permission to do so.
- Use any material or information, including images or photos, that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
- Upload files that contain viruses, Trojan horses, worms, time-based malware, programs intended to delete or damage files, or any other similar software or program that may damage another person's property.
- Download or publish any file that you know, or reasonably should know, cannot be lawfully distributed.
- Falsify or delete any author attribution, legal or other proper notice, proprietary designation, or label of origin or source contained in uploaded software or other materials.
- Exceed reasonable limits in a way that affects other users' enjoyment of the services.
- Violate any terms or any other guidelines that may apply to a particular service.
- Collect or otherwise gather information about others, including email addresses, unless your website requires it for operation and your website privacy policy, if any, permits it.
- Violate any applicable law or regulation.
- Create a false identity to mislead others.
- Create or operate a TOR node.
- Scan or sniff ports on other network hosts unless expressly authorized in writing by the target host and/or network; no other reason is permitted.
- Perform any type of BitTorrent download unless a particular service expressly states that such activity is permitted.
- Use a subscription in a manner inconsistent with its usage conditions, such as using an individual subscription plan within an organization or business.
ArcoVPN reserves the right to disclose any information whenever required by law, regulation, or government request, or to edit, remove, or refuse to publish any information or materials. ArcoVPN may do so in whole or in part at its sole discretion.
ArcoVPN does not control or endorse any content, messages, or information found through the services. Accordingly, ArcoVPN expressly disclaims any responsibility for actions or issues arising from your participation in the services.
When your service consumes excessive resources, such as high-volume downloads, cryptocurrency mining, or PT/BT downloads, ArcoVPN has the right to limit the resources provided to you at any time to protect normal use by other users on the same access point.
4. Termination / Restricted Access
ArcoVPN has no obligation to monitor the services. However, ArcoVPN reserves the right to review any services and materials posted on ArcoVPN and to decide, at its sole discretion, whether to remove services and content. ArcoVPN reserves the right, at its sole discretion and without any obligation to notify you, to terminate all or part of its services and related services, or to restrict access to them. For use that violates this Use Policy, once a service is terminated, ArcoVPN has no obligation to provide further maintenance.
5. No Spam
ArcoVPN will immediately terminate any service believed to be sending spam or large volumes of unsolicited email, and has no obligation to restore it.
6. Notice of Infringement Claims
ArcoVPN respects the intellectual property rights of others, and we require our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been infringed, please provide ArcoVPN with the following information:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
- A description of the copyrighted work or other intellectual property that you claim has been infringed;
- A description of the material in the service that you claim is infringing;
- Your address, telephone number, and email address;
- A statement by you that you have a good-faith belief that the disputed content is not authorized by the copyright owner, its agent, or the law;
- A statement confirming that the above information is accurate and that you are the owner, agent, legal representative, or authorized person for the copyright, intellectual property, or work.

7. Notice and Takedown Procedure
ArcoVPN reserves the right to implement a "notice and takedown" procedure at any time after receiving any notice claiming infringement. ArcoVPN reserves the right at any time to block access to or remove any material or activity accessible from any website, any material alleged to infringe, or any material or activity based on facts or circumstances that make infringing activity apparent.
